Definitions
1. Terms and Conditions of Sale – the terms of the distance purchase and sale agreement which set out the rights and obligations of the Buyer and the Seller when purchasing dresses, practice wear, and other products, as well as the payment terms, delivery and return procedures, liability of the parties, and other provisions related to the purchase and sale of goods carried out on the website www.emcouture.com.
2. Seller – Eglės Ateljė, UAB, legal entity code 235922310, address: Maironio g. 13-10, Kaunas, Lithuania.
3. Buyer – (1) a natural person who has reached the age of majority under the laws of the Republic of Lithuania and whose legal capacity is not restricted by a court; (2) a legal entity; or (3) duly authorised representatives of any of the above-mentioned persons.
4. Personal Data – the Buyer’s name, surname, telephone number, and email address.
General Provisions
5. These Terms and Conditions constitute a binding legal document for both parties and set out the rights and obligations of the Buyer and the Seller, the delivery and return procedures, the terms for purchasing and paying for goods, the liability of the parties, and other applicable conditions related to the purchase and sale of dress, practise wear and other on the website www.emcouture.com.
6. The Seller reserves the right to amend, supplement, or revise these Terms and Conditions at any time. Buyers are informed of any amendments, revisions, or supplements by publication on the Website www.emcouture.com. Buyers must review these Terms and Conditions before purchasing any goods. Amendments, revisions, or supplements to the Terms and Conditions shall enter into force upon their publication on the Website with a note “Amendment to the Terms and Conditions” and the indicated date of the amendment.
7. Only Buyers who meet the requirements set out in Clause 1.3 of these Terms and Conditions are entitled to purchase goods on the Website www.emcouture.com. By registering and/or purchasing goods, the Buyer confirms that they meet the requirements of Clause 1.3. In case of any doubts, the Seller reserves the right to request the Buyer to reconfirm their personal data.
8. The Seller has the right to refuse to sell goods to the Buyer if the requirements specified in Clause 1.3 are not confirmed.
Purposes and grounds for processing personal data
6. We process your personal data for the following purposes:
6.1. To deliver the orders you have submitted and to carry out product return procedures;
6.2. To provide you with news, special offers, and general information about the goods and services We offer;
6.3. To respond to the inquiries you submit;
6.4. To carry out internal data analysis, identify Website usage trends, and evaluate the effectiveness of advertising campaigns.
7. We process your personal data on the following grounds:
7.1. On the basis of your consent (Article 6(1)(a) of the Regulation);
7.2. On the basis of contract performance (Article 6(1)(b) of the Regulation);
7.3. On the basis of Our legitimate interests (Article 6(1)(f) of the Regulation).
Personal data protection
8. The Seller confirms that the Personal Data provided by the Buyer shall be processed solely for the purposes of selling dress, practise wear and other on www.emcouture.com, as well as for direct marketing and analytical purposes. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except in the following cases:
8.1. for the purpose of fulfilling an order or providing other services – to the Seller’s partners who provide delivery services or other services ordered by the Buyer;
8.2. to law enforcement authorities in accordance with the procedure established by the laws of the Republic of Lithuania;
8.3. where necessary to prevent or investigate criminal activities.
9. The Buyer has the following rights:
9.1. to be informed about the processing of their Personal Data;
9.2. to access their provided Personal Data and to know how such data are processed;
9.3. to receive information about to whom and for what purpose their Personal Data are processed and to whom they have been disclosed;
9.4. to request the rectification or erasure of their Personal Data and to suspend Personal Data processing activities;
9.5. to object to the processing of their Personal Data.
10. By purchasing dresses, practice wear, or other products on www.emcouture.com, the Buyer agrees that the Seller has the right to store their data on the server for an indefinite period, provided that there are legitimate grounds for storing Personal Data.
11. Any identity document presented by the Buyer to the Seller, employees of Lietuvos paštas, or courier service providers for inspection, as well as the data contained therein, shall be used solely for the purpose of verifying and identifying the Buyer’s identity.
12. Any request or instruction related to the processing of Personal Data must be submitted by the Buyer in writing by email to info@emcouture.com. Upon receipt of such a request or instruction, the Seller shall, no later than within 10 (ten) calendar days, provide the Buyer with a written response by email and carry out the actions specified in the request or instruction, or explain the reasons for refusing to do so.
Ordering Goods and Establishment of Purchase–Sale Legal Relationship
13. When placing an order on the website www.emcouture.com, the Buyer must provide accurate and complete information in the fields specified by the Seller that are necessary for the fulfilment of the order, including their name, surname, delivery address, telephone number, and email address. The Buyer agrees that information and notifications necessary for order fulfilment may be sent to them by email or SMS message. The Buyer agrees that part of the Buyer’s Personal Data may be transferred to the Seller’s partners (data processors) for the purpose of properly fulfilling the order and providing the requested services.
14. Once the Buyer selects the goods, forms the shopping cart, and confirms it by completing all the required order steps, it shall be deemed that a purchase–sale agreement has been concluded between the Buyer and the Seller and that legal purchase–sale relations have arisen.
15. The Buyer is informed by email or SMS message when all order steps have been completed correctly.
16. The Buyer’s orders are stored in the database of www.emcouture.com.
Buyer's rights and responsabilities
17. A Buyer who wishes to try on a dress in a foreign country undertakes to pay the full price of the dress as well as the shipping costs to the Seller’s bank account. The Buyer agrees that the dress shall be dispatched to the specified address only after the payment has been received in the Seller’s bank account.
18. The Buyer undertakes not to stain, tear, or otherwise damage the dress. The Buyer is prohibited from dancing in the dress or wearing it for any purposes other than fitting until the Seller is notified that the dress is suitable and the Buyer decides to keep it. Otherwise, EM Couture reserves the right not to refund the Buyer the amount paid for the dress.
19. If the dress is not suitable, the Buyer undertakes to return it immediately after fitting to the Seller or to a person authorised by the Seller (e.g. a sponsored dancer).
20. If the dress requires repair, the Buyer undertakes to cover all related repair costs.
Seller's rights and responsabilities
21. Seller undertakes to send the dress to the Buyer for fitting in (country) immediately after the payment for the dress has been received or on another mutually agreed date.
22. Seller shall remain the sole and legitimate owner of the dress until the Buyer provides written confirmation by email or message via social media that they decide to keep the dress.
23. If the dress is damaged (torn, stained, etc.) after fitting and return, Seller reserves the right not to refund the amount paid by the Buyer for the dress. If the dress is not suitable for the Buyer and, after return, its quality has not changed, Seller undertakes to refund the amount paid for the dress to the Buyer without delay. Shipping costs are non-refundable.
Delivery of goods (dress, practise wear and other)
24. When ordering goods on the website www.emcouture.com, the Buyer selects the preferred delivery method. When placing an order, the Buyer must provide complete and accurate information necessary for the proper fulfilment of the delivery service. If the provided information is incorrect due to the Buyer’s fault, the Buyer shall bear full responsibility for the non-delivery of the goods. Delivered not only within the Republic of Lithuania but also to foreign countries.
25. The Buyer undertakes to collect the ordered goods according to the selected delivery or collection method. If the Buyer fails to collect the goods using the chosen method and does not inform the Seller thereof, the Buyer shall have no right to submit claims against the Seller. If the goods (practive wear, dress, other) are returned to the sender’s address, the Buyer must contact the Seller using the provided contact details in order to arrange re-delivery. The costs of repeat shipment shall be borne by the Buyer.
26. The Seller undertakes to deliver the goods to the Buyer in accordance with the delivery time limits specified in the product descriptions. These time limits shall not apply in cases where the required or alternative goods are not available in the Seller’s warehouse, and the Buyer is informed about the unavailability of the ordered goods. The Buyer agrees that in the event of unforeseen circumstances beyond the Seller’s control, delivery times may differ from those specified in the product descriptions or agreed between the Buyer and the Seller. In such cases, the Seller undertakes to contact the Buyer without delay in order to agree on a new delivery time and resolve other delivery-related matters.
27. In all cases, the Seller shall be released from liability for delays in the delivery of goods if such delays occur due to circumstances beyond the Seller’s control.
Return of goods (dress, practise wear and other)
28. The Buyer has the right to return the goods within 14 (fourteen) days from the date of receipt, provided that the goods have not been used, damaged, or otherwise lost their commercial value, except for the cases provided for by law.
29. In accordance with the purchase–sale rules, if the Buyer wishes to return the goods, they must submit a request by email to info@emcouture.com, specifying the reasons for the return.
30. When returning goods, the Buyer must comply with the following conditions:
30.1. the returned goods must be in their original, undamaged packaging;
30.2. the returned goods must be unused, undamaged, unworn, not perspired, and free from any defects.
31. If the returned goods meet all of the above-mentioned return conditions, the Seller undertakes to refund the amount paid by the Buyer for the goods within 14 (fourteen) days, calculated from the date on which the returned goods are actually received by the Seller.
